Terms of Service – Sethu

By accessing or using Sethu, you agree to comply with these legally binding Terms.

1. Services Offered

• WhatsApp AI Bot: For property listing, lead organization, and broker collaboration.
• Sethu Portal: AI-powered property searches, deal tracking, documentation retrieval, and franchise applications.
• Value-Added Services: Loans, interiors, government document services, and recurring deal facilitation through third parties.

2. Ownership & Intellectual Property

• Sethu platform, software, trademarks, logos, and content are the exclusive intellectual property of Theia Real Estate Private Limited.

3. Broker Protection

• No Bypassing Guarantee: Brokers remain integral to all transactions. Sethu or its team will not directly contact property owners or clients introduced via brokers.
• Commission Independence: Brokers retain full control over commission negotiations unless voluntarily entering revenue-sharing arrangements for B2B or VAS services.

4. B2B Client Terms

• B2B clients acknowledge that data shared on Sethu may be used for deal facilitation, analytics, and service delivery within this framework.
• All B2B transactions remain confidential and broker-involved unless otherwise mutually agreed.

5. Fees & Commissions

• Brokers use core Sethu services free of charge.
• B2B deals: Brokers receive property owner commissions plus 60% of Sethu’s company-side commissions where applicable.
• Value-added services: Commissions paid by banks or service providers upon successful closures.

6. User Responsibilities

Users must not:

• Upload fraudulent or misleading property data.
• Engage in illegal activities or violate real estate regulations.
• Attempt unauthorized access, reverse engineering, or data scraping.

Violations may lead to account termination and legal action.

7. Data Usage & Analytics

• Aggregated, anonymized data may be used for market insights, platform improvement, and trend forecasting.
• No personally identifiable data disclosed without consent.

8. Limitation of Liability

• Sethu operates on a best-effort basis.
• Not liable for disputes between brokers, clients, or third parties beyond platform facilitation.
• Financial and legal obligations for transactions rest solely with involved parties.

9. Termination & Suspension

• Users can stop using Sethu anytime.
• Accounts engaged in fraudulent, illegal, or abusive activities may be suspended without notice.

10. Governing Law & Jurisdiction

• These Terms are governed by Indian laws with disputes under the jurisdiction of Bangalore, Karnataka.
